PREAMBLE
These Terms of Use (hereinafter "the Terms") govern access to and use of the izyPet platform (hereinafter "the Platform"), published by SARL DAMONI, a French limited liability company with a share capital of 1,000 euros, registered with the Trade and Companies Register (RCS) of Limoges under number 982 444 580, with its registered office at 3 chemin de la Font — 87510 Saint-Jouvent — France (hereinafter "izyPet" or "We").
The Platform is accessible via the website https://izypet.co and through mobile applications available on the Google Play Store (Android) and the App Store (iOS).
By using the Platform, you agree to be bound by these Terms in their entirety. If you do not accept these Terms, you must not use the Platform.
PART I — GENERAL PROVISIONS
Article 1 — Definitions
In these Terms, the following terms have the meanings set out below:
- "Platform": all services accessible via the izypet.co website and the izyPet mobile applications, including all features offered.
- "User": any natural or legal person accessing the Platform and holding an account, whether a Professional or a Client.
- "Professional" or "Pro": any pet care industry professional (boarding facility, groomer, pet sitter, dog trainer, etc.) registered on the Platform through a paid subscription to manage their business. The Professional is the data controller for their own Clients' data under the GDPR.
- "Client": any natural person, pet owner, using the Platform to interact with a Professional (booking requests, viewing contracts, invoices, etc.). The Client does not have a direct commercial relationship with izyPet.
- "Animal": any pet (dog, cat, or exotic pet) registered on the Platform.
- "Booking": any service request made by a Client or a Professional through the Platform.
- "Contract": a contractual document generated through the Platform between a Professional and a Client, relating to one or more services.
- "Invoice": an accounting document generated by a Professional through the Platform for a Client.
- "Services": all features offered by the Platform to Users.
- "Account": the personal space created by the User upon registration, granting access to the Services.
Article 2 — Purpose
These Terms define the conditions and procedures for accessing and using the Platform.
The izyPet Platform is an online management tool (SaaS — Software as a Service) designed for pet care industry professionals. It enables, among other things:
- Booking and scheduling management;
- Creation and electronic signing of contracts;
- Generation and sending of invoices and quotes;
- Management of animal records and client files;
- Communication between Professionals and Clients;
- Access to a voice AI assistant (available to Professionals only).
The Platform is a management assistance tool and is in no way a substitute for the legal, regulatory, accounting, tax, or professional obligations incumbent upon the Professional. It is the Professional's responsibility to ensure compliance with all regulations applicable to their business, including obligations not covered by the Platform (in particular, but not limited to: maintaining an animal entry and exit register, keeping a receipt book, filing tax and social security declarations, obtaining professional liability insurance, and securing any required permits and certifications). izyPet does not guarantee that using the Platform will enable the Professional to fulfil all of their legal and regulatory obligations.
Article 3 — Acceptance of the Terms
Registration on the Platform and use of the Services are conditional upon prior, unreserved acceptance of these Terms.
The User acknowledges having read these Terms and accepts them by checking the appropriate box during Account creation. This acceptance constitutes a legally binding agreement between the User and izyPet.
The applicable Terms are those in effect on the date the Platform is used. izyPet reserves the right to modify them at any time. In the event of a material change, Users will be notified by email at least thirty (30) days before the new Terms take effect. Material changes will require express acceptance by the User upon their next login to the Platform. If the User does not accept, they may terminate their Account at no cost. Non-material changes (typographical corrections, contact information updates, etc.) take effect upon publication.
Article 4 — Access to the Platform
The Platform is available 24 hours a day, 7 days a week, subject to interruptions for maintenance, updates, or force majeure events.
izyPet uses reasonable efforts to ensure Platform availability but does not guarantee uninterrupted access. izyPet shall not be held liable for Internet network disruptions, hardware failures, or any other event beyond its control that prevents or degrades access to the Platform.
The Platform is designed to work with the following browsers in their two most recent major versions: Google Chrome and Safari. Using an unsupported or outdated browser may cause issues for which izyPet cannot be held responsible.
PART II — REGISTRATION AND USER ACCOUNTS
Article 5 — Account Creation
5.1 Registration requirements
Registration on the Platform is open to any adult natural person or any legal entity, provided they supply accurate and complete information.
To create an Account, the User must provide:
- A valid email address;
- A password (minimum 8 characters);
- Acceptance of these Terms and the Privacy Policy.
Professionals must also provide their business name upon registration.
5.2 Dual role
A single User may hold both Professional and Client roles (for example, a professional using a colleague's services in a personal capacity). Both roles are linked to the same Account and email address.
5.3 Accuracy of information
The User agrees to provide accurate, complete, and up-to-date information upon registration and to keep it current throughout their use of the Platform. The User is solely responsible for any consequences arising from inaccurate, incomplete, or outdated information.
Article 6 — Account Security
6.1 Confidentiality of credentials
The User is responsible for keeping their login credentials (email and password) confidential. Any use of the Platform from their Account is deemed to have been carried out by the User.
6.2 Notification in case of compromise
In the event of loss, theft, or unauthorized use of their credentials, the User must notify izyPet without delay at contact@izypet.co. izyPet will reset access as promptly as possible.
6.3 Liability
izyPet shall not be held liable for any damages resulting from fraudulent use of a User's Account by a third party, unless izyPet is at fault.
Article 7 — Account Deletion
7.1 Account closure by the User
Any User may close their Account from their account settings. Closure results in:
- Immediate deactivation of Account access (login credentials are deleted);
- Removal of the business from search results;
- Hiding of the business from search results and deactivation of access.
Data retained after closure: certain personal data (including name, address, and contact details) are retained because they are necessary for the proper functioning of the Platform for other Users. In particular:
- Data relating to past bookings is retained so that Professionals and Clients can keep their history;
- Data required for accounting and billing purposes is retained in accordance with applicable legal obligations (particularly accounting and tax requirements);
- Client records created by a Professional remain accessible to that Professional, and vice versa.
To request further deletion of your personal data, you may exercise your right to erasure under the conditions set out in our Privacy Policy.
7.2 Account deletion by izyPet
izyPet reserves the right to suspend or delete an Account in the event of:
- Breach of these Terms;
- Provision of false or misleading information;
- Fraudulent or abusive use of the Platform;
- Non-payment of subscription by a Professional (after unsuccessful reminders);
- Prolonged Account inactivity (in accordance with our Privacy Policy).
The User will be notified by email prior to any suspension or deletion of their Account, except in cases of emergency or serious breach.
PART III — PROVISIONS SPECIFIC TO PROFESSIONALS
Article 8 — Subscription and Financial Terms
Use of the Platform by Professionals is subject to a paid subscription, the terms of which are set out in the Terms of Sale.
A free trial of two (2) months is offered to every new Professional upon registration.
Professionals who meet the conditions of Article L.221-3 of the French Consumer Code (Code de la consommation) benefit from a right of withdrawal as detailed in Article 8 of the Terms of Sale.
Article 9 — Professional Obligations
9.1 General obligations
The Professional agrees to:
- Use the Platform in accordance with its intended purpose and these Terms;
- Provide accurate and complete information regarding their business, services, and pricing;
- Comply with regulations applicable to their professional activity, including animal welfare, health and safety, and consumer protection;
- Independently ensure compliance with all of their legal, regulatory, accounting, and tax obligations, including those not handled by the Platform. The Platform does not constitute legal, accounting, or tax advice and is not a substitute for guidance from a qualified professional (lawyer, accountant, etc.);
- Respect Clients' rights, particularly regarding personal data protection.
9.2 Data controller
The Professional is the data controller within the meaning of the General Data Protection Regulation (GDPR) for the personal data of their Clients collected and processed through the Platform. Accordingly:
- They determine the purposes and means of processing their Clients' data;
- They are required to comply with GDPR obligations (information, data subjects' rights, security, etc.);
- They acknowledge that izyPet acts as a data processor for such data, in accordance with the Data Processing Agreement (DPA) appended hereto.
The Professional agrees not to collect, through the Platform, any personal data from Clients that is not necessary for the conduct of their business.
9.3 Contracts and invoices
The Professional is solely responsible for the content of contracts, quotes, and invoices they generate through the Platform. izyPet provides the generation tools but does not verify the legal compliance or accuracy of documents produced by the Professional.
The Professional is required to comply with applicable accounting and tax obligations in their country, particularly regarding sequential invoice numbering, mandatory mentions, and document retention.
9.4 Electronic signature
The Platform offers an electronic signature feature for contracts. This signature constitutes a simple electronic signature within the meaning of Article 3.10 of the eIDAS Regulation (EU) No 910/2014. It does not constitute an advanced or qualified electronic signature.
The Professional acknowledges that the evidentiary value of this signature depends on the applicable law and the circumstances of each case. It is the Professional's responsibility to assess whether the signature level offered is suitable for their needs.
Article 10 — Features Available to Professionals
10.1 Booking management
The Professional can:
- Receive and manage booking requests from their Clients;
- Create bookings directly for their Clients;
- Confirm, decline, or cancel bookings;
- Configure their services, pricing, availability, and capacity;
- Set up recurring bookings.
10.2 Contract and financial management
The Professional can:
- Generate customized contracts and quotes;
- Collect electronic signatures;
- Generate and send invoices;
- Track payments;
- Customize their documents (legal information, additional details, logo).
10.3 Voice AI assistant
The Platform provides Professionals with a voice assistant powered by artificial intelligence (Google Gemini). This assistant can help the Professional to:
- Search for information about their animals and bookings;
- Create draft contracts;
- Obtain general information related to their business.
Terms of use for the AI assistant:
- The AI assistant requires access to the User's device microphone;
- Voice conversations are transmitted in real time to Google servers located in the United States for processing. When the assistant performs searches (for animals, bookings), personal data of the Professional's Clients (owner names, animal names, booking dates, and related information) may also be transmitted to Google servers. This transfer is governed by the safeguards described in our Privacy Policy (Standard Contractual Clauses / EU-US Data Privacy Framework);
- Conversations (text and audio) are recorded and stored by izyPet for ninety (90) days for service improvement and diagnostic purposes;
- The AI assistant provides suggestions that do not constitute professional, legal, or veterinary advice;
- The Professional remains solely responsible for decisions made based on information provided by the AI assistant;
- Use of the AI assistant is subject to Google Gemini's terms of use.

10.4 Scheduling and calendar
The Professional can:
- Manage their schedule (booking view, capacity);
- Set unavailability periods;
- Create calendar events;
- Customize schedule display (animal icons, signature status).
10.5 Email notifications
The Platform sends automated emails on behalf of the Professional, including:
- Booking confirmations to Clients;
- Booking reminders (1 day before) to Clients;
- Contract signing requests;
- Invoice delivery;
- Boarding companion notifications (buddy notifications).
The Professional can configure the frequency of certain notifications they receive (booking requests).
PART IV — PROVISIONS SPECIFIC TO CLIENTS
Article 11 — Free Service for Clients
Use of the Platform by Clients is free of charge. Clients do not have a direct commercial relationship with izyPet. Their contractual relationship is with the Professional whose services they use.
Article 12 — Client Obligations
The Client agrees to:
- Provide accurate and complete information when creating their Account and managing their animal records;
- Comply with the booking and cancellation terms set by each Professional;
- Use the Platform fairly and in accordance with these Terms;
- Not use the Platform for unlawful purposes or purposes contrary to its intended use.
Article 13 — Features Available to Clients
13.1 Profile and animal management
The Client can:
- Create and edit their profile (name, phone, address);
- Register one or more animals with their details (name, breed, identification number, date of birth, sex, neutering status, type);
- Enter veterinary information for their animals;
- Provide an emergency contact.
13.2 Bookings
The Client can:
- Search for professional businesses on the Platform;
- Submit booking requests to a Professional;
- View the status of their bookings (pending, confirmed, declined, cancelled);
- Cancel a booking (within limits set by the Professional).
13.3 Contracts and invoices
The Client can:
- View contracts generated by a Professional for their bookings;
- Electronically sign contracts;
- View invoices issued by a Professional;
- Download documents (contracts, invoices) in PDF format.
13.4 Notifications
The Client receives automated emails, including:
- Booking confirmations;
- Reminders before a service begins;
- Contract signing invitations;
- Invoices;
- Boarding companion notifications (with an option to unsubscribe).
13.5 Boarding companion notifications (buddy)
The Platform offers a feature that notifies a Client when an animal they have designated as a "companion" (buddy) has a booking at the same facility around the same dates. In this context:
- The Client may receive an email containing the name of another Client's animal and the relevant booking dates;
- This feature involves limited data sharing between Clients, strictly limited to the necessary information (animal name and dates);
- The Client can unsubscribe from these notifications at any time via the unsubscribe link in each email or from their Account settings.
PART V — COMMON PROVISIONS
Article 14 — User Conduct
All Users agree to:
- Not interfere with the operation of the Platform (intrusion attempts, introduction of viruses, deliberate overloading, etc.);
- Not impersonate another person;
- Not collect or extract data from the Platform by automated means (scraping, crawling);
- Not use the Platform to transmit unlawful, defamatory, insulting, discriminatory, or public order-violating content;
- Respect the intellectual property rights of izyPet and third parties.
Article 15 — Intellectual Property
15.1 izyPet's rights
The Platform, its architecture, source code, design, text, images, logos, and all elements comprising it are the exclusive property of SARL DAMONI and are protected by intellectual property law.
The User is granted a personal, non-exclusive, non-transferable, and non-assignable right to use the Platform for its normal use and in accordance with these Terms.
15.2 User content
The User retains intellectual property rights over all content they post or upload to the Platform (text, images, logos, documents). By uploading such content, the User grants izyPet a non-exclusive, worldwide, royalty-free license, limited in time to the duration of Platform use, solely for storage, display, and transmission purposes necessary for the operation of the Service.
Article 16 — izyPet's Liability
16.1 Role as technical intermediary
izyPet provides a management tool and is not party to contractual relationships between Professionals and their Clients. izyPet is not a party to contracts entered into between a Professional and a Client through the Platform.
Accordingly, izyPet shall not be held liable for:
- The quality, safety, or compliance of services provided by Professionals;
- Disputes between a Professional and a Client;
- The content of contracts, invoices, or any other document generated by a Professional;
- Decisions made by a Professional regarding bookings (acceptance, refusal, cancellation);
- Damages caused by animals to Users, Professionals, or third parties, whether during boarding, grooming, training, or any other service arranged through the Platform.
16.2 Limitation of liability
To the extent permitted by applicable law, izyPet shall only be liable in the event of proven fault on its part. In any event, izyPet's liability is limited to direct and foreseeable damages and shall not exceed, for a Professional, the amounts paid by that Professional for their subscription during the twelve (12) months preceding the event giving rise to the claim.
To the extent permitted by applicable law, izyPet shall not be liable for indirect damages, such as loss of revenue, loss of clients, loss of data, reputational damage, or non-material losses.
16.3 Force majeure
izyPet shall not be held liable for failure to perform its obligations resulting from a force majeure event within the meaning of Article 1218 of the French Civil Code (Code civil), including but not limited to: natural disasters, pandemics, war, strikes, Internet network failures, hosting provider failures, cyberattacks, or administrative or judicial decisions.
Article 17 — Platform Changes
izyPet reserves the right to modify the Platform at any time, including by adding, changing, or removing features.
Such changes shall not give rise to compensation, except where they render the Service significantly unusable for a subscribing Professional, in which case the Professional may terminate their Subscription in accordance with the Terms of Sale.
Article 18 — Personal Data Protection
Users' personal data is processed in accordance with our Privacy Policy.
For Client data processed by izyPet on behalf of the Professional, a Data Processing Agreement (DPA) is entered into between izyPet and the Professional.
Article 19 — Hyperlinks
The Platform may contain hyperlinks to third-party websites. izyPet has no control over these websites and disclaims all liability regarding their content, data protection practices, or availability.
Article 20 — Severability
If any provision of these Terms is declared null or unenforceable by a competent court, the remaining provisions shall continue in full force and effect.
Article 21 — Waiver
The failure by izyPet to exercise any right under these Terms shall not constitute a waiver of that right.
Article 22 — Governing Law and Jurisdiction
22.1 Governing law
These Terms are governed by French law, regardless of the User's country of residence.
22.2 Jurisdiction
For Professionals: in the event of a dispute relating to the interpretation, performance, or termination of these Terms, and in the absence of an amicable resolution within thirty (30) days of notification of the dispute by either party, the competent courts of Limoges (France) shall have exclusive jurisdiction.
For Clients residing in the European Union: in accordance with Regulation (EU) No 524/2013, Clients may use the European Commission's online dispute resolution platform: https://ec.europa.eu/consumers/odr. In the absence of an amicable resolution, the courts having jurisdiction under ordinary rules of law shall be competent. Consumers residing in the EU benefit from the mandatory consumer protection provisions of their country of residence.
For Clients residing outside the European Union: in the absence of an amicable resolution, the courts of Limoges (France) shall have jurisdiction, without prejudice to any mandatory consumer protection provisions applicable in the Client's country of residence.
